  • Shippers - businesses and individuals who book freight transportation through Borderlanders.
  • Drivers - employed and contracted drivers operating under Borderlanders authority.
  • Carriers & Partners - logistics partners, brokers, and third-party carriers we work with.
  • Website Visitors - anyone who visits borderlandersinc.com.

2. Information We Collect

Depending on your relationship with us, we may collect:

From Shippers

  • Business name, contact name, email address, and phone number.
  • Shipment details including origin, destination, freight type, weight, and delivery windows.
  • Billing and invoicing information.
  • Load history and communication records.

From Drivers

  • Full legal name, date of birth, and government-issued ID.
  • Commercial Driver's License (CDL) number, endorsements, and expiration.
  • Employment history, driving record (MVR), and drug & alcohol screening results.
  • Medical Examiner's Certificate (DOT physical) and clearinghouse registration.
  • Electronic Logging Device (ELD) data including hours of service (HOS), location, and vehicle diagnostics.
  • Direct deposit and tax information for payroll.

From Carriers & Logistics Partners

  • Company name, MC/DOT number, and insurance certificates.
  • W-9 or tax identification information for payment processing.
  • Contact names, email addresses, and phone numbers.
  • Rate confirmations, load communications, and compliance documents.

From All Users

  • IP address, browser type, device, and pages visited on our website.
  • Communications sent to us by email, phone, or web form.

3. How We Use Your Information

We use the information we collect to:

  • Dispatch loads, coordinate pickups and deliveries, and manage freight operations.
  • Onboard, qualify, and manage drivers in compliance with FMCSA regulations (49 CFR Parts 391, 395).
  • Monitor ELD and HOS data to ensure regulatory compliance and driver safety.
  • Process payments, generate invoices, and manage payroll.
  • Respond to inquiries, quotes, and support requests from shippers and partners.
  • Maintain records required by DOT, FMCSA, and applicable state regulations.
  • Investigate accidents, incidents, or compliance violations.
  • Improve our operations, services, and website experience.

4. Sharing of Information

We do not sell your personal information. We may share information in the following circumstances:

  • With shippers - driver name and contact information may be shared for coordination of pickup and delivery.
  • With regulatory bodies - FMCSA, DOT, state agencies, and law enforcement when required by law or in response to an investigation.
  • With service providers - ELD vendors, insurance carriers, background check providers, and payroll processors who operate under confidentiality agreements.
  • In a business transfer - if Borderlanders is acquired or merged, your information may transfer as part of that transaction.

5. Driver Data & FMCSA Compliance

Driver information collected by Borderlanders is subject to federal recordkeeping requirements. We maintain driver qualification files (DQ files) and ELD records in accordance with FMCSA regulations. Driver qualification records are retained in accordance with 49 CFR § 391.51, including records that must be kept during employment and for specified periods after employment ends. ELD records, records of duty status, and supporting documents are generally retained for at least 6 months as required by FMCSA rules. All records may be made available to authorized federal or state inspectors upon request.

Drivers have the right to inspect their own records held by Borderlanders and to request corrections to inaccurate information, subject to regulatory constraints.

6. ELD & Telematics Data

Vehicles operating under Borderlanders authority are equipped with FMCSA-registered Electronic Logging Devices. ELD data - including location, speed, engine hours, and HOS records - is collected continuously during active operations. This data is used solely for compliance, safety, and operational purposes. It is not sold or used for advertising.

7. Data Security

We apply industry-standard administrative, physical, and technical safeguards to protect your information. Sensitive records such as CDL data, medical certificates, and financial information are stored securely with access limited to authorized personnel. No transmission over the internet is entirely secure, and we cannot guarantee absolute protection.

8. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this policy, or as required by law. Regulatory records are kept for the minimum periods mandated by FMCSA and DOT. Non-regulatory business records are generally retained for 3 years following the end of a business relationship.

9. Cookies & Website Tracking

Our website uses cookies to understand how visitors interact with our pages. We do not use advertising trackers or sell browsing data. You can disable cookies in your browser settings; doing so will not affect your ability to contact us or use our services.

10. Your Rights

Depending on your location and applicable law, you may have the right to:

  • Access the personal information we hold about you.
  • Request correction of inaccurate data.
  • Request deletion of data we are not legally required to retain.
  • Object to or restrict certain processing of your information.

11. SMS & Text Messaging Program

Borderlanders Inc. operates an SMS notification program to send load status updates, dispatch alerts, and operational communications to drivers, shippers, and logistics partners who have opted in.

How to Opt In

You may opt in to receive SMS messages from Borderlanders by providing your mobile phone number directly to our dispatch team, completing an onboarding form, or responding to a written opt-in request. By providing your number and consenting, you agree to receive text messages at the number provided.

Message Frequency

Message frequency varies based on operational activity. Drivers and active shippers may receive multiple messages per day during active loads. Administrative and onboarding communications are sent as needed.

Message & Data Rates

Message and data rates may apply. Charges are determined by your mobile carrier and plan. Borderlanders does not charge for SMS messages directly.

How to Opt Out

Reply STOP to any message at any time to unsubscribe. You will receive one confirmation message confirming your opt-out. After that, Borderlanders will not send further SMS messages to that number unless you separately provide renewed consent or unless communication is legally required and permitted by applicable law.

Data Use

Mobile numbers and SMS opt-in data are used solely for the operational communications described above. SMS consent, mobile phone numbers, and opt-in data will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes. 12. Changes to This Policy

We may update this policy as our operations or applicable laws change. Material updates will be posted on this page with a revised effective date. Where required by law, we will provide additional notice or obtain consent before applying material changes.
