1. Acceptance of Terms

By accessing the Borderlanders Inc. website, contacting our dispatch team, booking a load, or using any of our services, you agree to be bound by these Terms & Conditions. These terms apply to shippers, drivers, carriers, logistics partners, and website visitors. If you do not agree, do not use our services.

2. Services Provided

Borderlanders Inc. is a licensed motor carrier operating under FMCSA authority. We provide the following freight transportation services:

  • On Time Transportation - full truckload freight, direct carrier service.
  • Power Only Trucking - tractor-only service for shipper-owned or drop trailers.
  • Expedited Team Service - two-driver team operations for time-critical freight.
  • 24/7 Dispatch Support - around-the-clock load coordination and shipment monitoring.

All services are subject to equipment availability, regulatory compliance, and route feasibility. Borderlanders reserves the right to decline any load at its discretion.

3. Shipper Responsibilities

If you are booking freight with Borderlanders, you agree to:

  • Provide accurate and complete freight descriptions, including commodity type, weight, dimensions, and any special handling requirements.
  • Declare all hazardous materials in compliance with DOT 49 CFR regulations prior to tender. Failure to disclose hazmat will result in immediate load rejection and may incur additional fees.
  • Ensure freight is properly packaged, palletized, and secured for transport. Borderlanders is not responsible for damage resulting from improper packaging by the shipper.
  • Have freight ready at the agreed pickup time. Detention fees apply after the first 2 hours of free time, at rates established in the service agreement.
  • Provide accurate delivery addresses, receiver contact information, and any facility access requirements (appointments, TWIC, lumper, etc.).

4. Cargo Liability

Borderlanders Inc. operates as a carrier subject to cargo liability under the Carmack Amendment (49 U.S.C. § 14706). Our liability for cargo loss or damage is limited to the actual value of the freight at the time of shipment, subject to the terms of the applicable bill of lading and any written service agreement.

Borderlanders is not liable for cargo damage or loss resulting from: acts of God, shipper error, improper packaging, inherent vice of the goods, government actions, or circumstances beyond our reasonable control. Shippers are encouraged to maintain appropriate cargo insurance for high-value shipments.

All claims for loss or damage must be filed in writing within 9 months of delivery (or the expected delivery date in the case of non-delivery), as required by federal transportation law.

5. Payment Terms

Payment terms are established in individual rate confirmations or service agreements. Unless otherwise agreed in writing:

  • Invoices are due within the period specified on the rate confirmation.
  • Late payments may accrue interest at 1.5% per month or the maximum rate permitted by law.
  • Shippers are responsible for all reasonable collection costs, including attorney fees, in the event of non-payment.
  • Borderlanders reserves a carrier's lien on freight in its possession for unpaid charges.

6. Driver & Contractor Terms

Drivers and independent contractors engaging with Borderlanders agree to:

  • Maintain a valid Commercial Driver's License (CDL) with appropriate endorsements at all times.
  • Operate in full compliance with FMCSA Hours of Service regulations and all applicable DOT requirements.
  • Use Borderlanders-approved Electronic Logging Devices (ELDs) during all operations under our authority.
  • Comply with drug and alcohol testing requirements under 49 CFR Part 382.
  • Report all accidents, incidents, and cargo issues to dispatch immediately.
  • Maintain the confidentiality of shipper information, load details, and business communications.

7. SMS & Text Messaging Consent

By providing your mobile phone number to Borderlanders and agreeing to receive SMS communications, you consent to receive text messages related to load dispatch, shipment updates, operational alerts, and administrative notifications.

  • Opt-in: Consent is obtained by providing your number directly to our team or via a written onboarding form.
  • Frequency: Message frequency varies based on operational activity.
  • Rates: Message and data rates may apply per your mobile carrier plan.
  • Opt-out: Reply STOP at any time to unsubscribe. A confirmation will be sent and no further messages will follow.
  • Help: Reply HELP for assistance, or contact us at dispatch@borderlandersinc.com.

8. Force Majeure

Borderlanders shall not be liable for delays or failure to perform services resulting from circumstances beyond our reasonable control, including but not limited to: severe weather, natural disasters, road closures, government actions, fuel shortages, mechanical breakdowns, or labor disputes. In such events, we will notify affected parties promptly and work to minimize disruption.

9. Fraud & Impersonation Disclaimer

Borderlanders Inc. disclaims all liability for fraudulent load bookings, unauthorized communications, or phishing attempts by third parties - even if those communications appear to originate from our email domain or phone numbers. Always verify any unusual communication by contacting us directly through borderlandersinc.com before acting on load offers, payment changes, or wire transfer requests.

10. Limitation of Liability

To the fullest extent permitted by law, Borderlanders Inc. shall not be liable for indirect, incidental, punitive, or consequential damages arising from the use of our services or website. Our total liability to any party for any claim shall not exceed the amount paid by that party for the specific service giving rise to the claim.

11. Dispute Resolution

Any dispute arising from or related to these Terms or our services shall first be submitted to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association (AAA), conducted in the state where Borderlanders Inc. is registered. The prevailing party shall be entitled to recover reasonable attorney fees and costs.

12. Governing Law

These Terms are governed by the laws of the United States and the state in which Borderlanders Inc. is registered, without regard to conflict of law provisions. Federal transportation law, including the Carmack Amendment and FMCSA regulations, governs all matters related to freight transportation.

13. Changes to These Terms

We reserve the right to update these Terms at any time. Material changes will be posted on this page with a revised effective date. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
